The learned counsel for the petitioner submits that the petitioner was disqualified by the Collector under Section 14 (1) (j) of the Maharashtra Village Panchayat Act. The petitioner preferred an appeal before the Divisional Commissioner. The stay was granted till the next date of hearing. The fresh elections for the post of Sarpanch are called by the Tahsildar on 25.08.2021. The election is to take place on 02.09.2021.The petitioner was issued with the notice to remain present for the special meeting on 27.08.2021. The same is abruptly cancelled on 30.08.2021.

It would appear that the petitioner did not remain present on

2 963-wp 9774-2021.odt 20.08.2021 before the Commissioner and the next date is fixed on 03.09.2021. The petitioner had resigned as a Sarpanch. 3.

Considering all the aforesaid aspects of the matter and considering the pendency of the appeal, at present, we are not inclined to entertain the petition.
