Heard learned Advocate for the petitioner and the learned AGP for respondent Nos.1 and 2. Mr. M.D. Narwadkar, the learned counsel appearing for respondent No.3 submits that the petitioner would be considered in the second round from the same quota. Mr. Phatale, the learned counsel submits that the petitioner was allotted respondent No.4 college. The petitioner was admitted to BDS course. The learned counsel submits that 20.11.2020 was the last date for

WP_7923_2020 the petitioner to submit validity certificate. The petitioner was admitted from Scheduled Tribe category. On 20.11.2020 itself this Court allowed the writ petition of the petitioner directing committee to issue validity certificate to the petitioner. The office of the scrutiny committee could issue the validity certificate to the petitioner in the late evening and thereafter the petitioner approached the authorities and the respondent No.4 for submission of validity certificate. The same was not accepted. According to Mr. Narwadkar, the learned counsel, the validity certificate was to be submitted till 5.00 p.m. on 20.11.2020. It appears that because of the matter being decided in the late afternoon the committee could issue the validity certificate in the late evening. Though the petitioner is issued with validity certificate the petitioner is deprived of the admission. The petitioner certainly does not appear at fault.

In case the seat allotted to the petitioner in the first round is not allotted to any other person then the same seat be allotted to the petitioner. If for some reason the seat, that was allotted to the petitioner in the first round, was allotted to some other candidate then the respondent shall consider the petitioner for the second round from the same quota.

WP_7923_2020 Writ petition is disposed of. No costs.
