By this application under section 438 of the Code of Criminal Procedure, the applicant seeks his release on pre-arrest bail, in connection with C.R. No.107 of 2015, registered with Police Station, Ashti, District Beed, for offence under sections 326, 324, 323, 147, 148, 149, 504 and 506 of the Indian Penal Code.

Specific role is attributed to the applicant, in the first information report registered against him, as having given an axe blow to the injured Ganesh on his head.

The ground sought to be raised for grant of bail, that the injured Ganesh was shifted to a private hospital and not to the Government

(2) criap4192.15 hospital, will hardly be of any assistance to the applicant, in view of the availability of prima facie case and evidence against him, in the investigation carried out by the investigating agency. 4.

In the light of above, in my opinion, this is not a fit case for grant of pre-arrest bail. Thus, the Criminal Application stands rejected. (N.W. SAMBRE, J.) amj
