Perused Government Resolution dated 27.06.2008 issued by the General Administration Department, wherein mechanism/procedure is provided, when two candidates secure equal marks, in such case who can be appointed. Respondent No.4 was in second year B.A. course and petitioner was in first year B.A. course on the date of filing the applications. Applying sub-clause (1) of clause-6 of the said Government Resolution, the respondent No.4 is appointed on the post of Police Constable. In that view of the matter, in our opinion, respondent No.4 has been rightly selected and issued appointment order. No case is made out. The writ petition stands rejected.
