Mr. Patil, the learned counsel for petitioners submits that, the petitioners have filed proposal for opening new commerce computer typing education institute as per the policy of the Government under Government Resolution dated 05.12.2016. The proposal is complete in all respect. The same is not considered.

The Deputy Education Officer (Secondary), Zilla Parishad, Jalgaon has filed affidavit. Para No. 3 of the affidavit reads thus :

I say and submit that, on receipt of the proposal the Respondent No. 6-Education Officer (Secondary) Jalgaon has submitted the same to the Respondent No. 5-Dy. Director of Educatiion, Nashik Division, Nashik vide its letter dated 3/08/2017 for necessary action. In response to the same Deputy Director of Education, Nashik Division Nashik by letter dated 4-9-2018 informed that, the State Government has stopped to grant permission for the proposal received after 15/03/2015 to run new commerce computer Typing Education Institute until further orders. The copy of the letter dated 4-92018 issued by the Deputy Director of Education, Nashik Division, Nashik is annexed herewith and marked as EXHIBIT R-1."

As the policy decision has been taken to stop grant of permission for proposals received after 15.03.2015, we cannot direct the respondents to consider the proposal. However, as and when decision would be taken by the respondents to grant permission to commerce computer typing education institute, then the proposal of the petitioners shall also be considered at the said time.

In view of the above the writ petition is disposed of. No costs.
