There are specific attributions as against applicant no.1 Lahu. In view thereof, learned Counsel appearing on behalf of the applicants does not press pre-arrest bail application to his extent and, therefore, it stands disposed of.

So far as applicants no.2, 3 and 4 are concerned, there are no specific attributions against them in the first information report, as also statements of witnesses, as regards commission of offence punishable under section 392 read with sec. 34 of the Indian Penal Code. Furthermore, there appears to be a complaint, prior in point of time,
(2) criap4199.15 against the complainant in the present case, at the behest of the applicants for offence punishable under section 323 of the Indian Penal Code, of which cognizance is already taken.

In view thereof, it will be appropriate to order release of applicants no.2, 3 and 4 on pre-arrest bail. As such, following order :- In the event of arrest of applicant no.2 Akash s/o Lahu Khandagale, applicant no.3 Satyawan s/o Bajirao Khandagale and accused no.4 Dayanand s/o Dagadu Gawali, in connection with C.R. No.49 of 2015, registered with Police Station, Bembli, Taluka and District Osmanabad, for offence punishable under section 392 read with sec. 34 of the Indian Penal Code, each of them be released on furnishing P.R. Bond of Rs.10,000/- with one surety of like amount. They shall attend the concerned police station as and when called for. Criminal Application stands disposed of in above terms. (N.W. SAMBRE, J.) amj
