Applicant prays for transposition of respondent No. 4 - Annasaheb Basvappa and the respondent No. 5 - Dhanraj Yallappa as co-appellants.

It is submitted that respondent Nos. 4 and 5 referred above are also claimants along with applicants. They have filed joint reference bearing L. A. R. No. 469 of 2010. They were not available for the signature. Therefore, they were required to be made as party respondents in the first appeal. It is submitted that in order to avoid complications and now they have given power to the counsel, it is desirable to transpose them as appellants. It is contended that they have no objection for the

I find that the respondent Nos. 4 and 5 are original claimants. The submission of the learned counsel for the applicants can be accepted. For the reasons stated in the application, the civil application is allowed in terms of prayer clauses 'B' and 'C'. The civil application is disposed of. 4.

Amendment to be carried within a period of two weeks from today.
