Heard the learned counsel for the applicant and learned APP for the respondent-State.

The facts of the case have been discussed in detail in the order dated 22.08.2022. The FIR reveals that the deceased had affair with the wife of the applicant. The wife of the applicant and deceased had attempted to commit suicide. However, they were saved. The deceased had developed relation with another woman. Considering this fact, this court is of the view that the custodial interrogation of the applicant is not essential. Therefore, the application deserves to be allowed. Hence, the following order :

O R D E R

(i) The application is allowed.

(ii) The interim protection granted to the applicant by the order dated 22.08.2022 stands confirmed on the same terms and conditions.
