PER COURT:- 1.

The learned counsel for respondent nos.3 to 5 on instructions states that, during the pendency of this Writ Petition, respondent nos.3 to 5 have already issued work order in favour of the successful bidder on 31.01.2022. The statement is accepted.

In view of the fact that, respondent nos.3 to 5 already having been issued work order in favour of the successful bidder in the month of January, 2022, we do not interfere with the award of contract to the successful bidder.

It is made clear that, in view of the facts of this case, we are not going into the validity of the impugned Circular dated 31.09.2020

(2) 904-wp-7962-2020 and more particularly, Clause 2 thereof prohibiting participation of the members of the family whose family member has been already in the employment of the University or has already retired.

Writ Petition is disposed of in the aforesaid terms. No orders as to costs.
