This is an application for bail under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0172/2022, registered at Akkalkuwa Police Station, District Nandurbar, for the offences punishable under Sections 392, 395 read with 34 of the Indian Penal Code. 2.

Heard. Perused the First Information Report (FIR) and related papers.

In test identification parade, the applicant has not been identified. What has been recovered from him is a sum of

(( 2 )) 961-BA-1317-2022 Rs.10,000/-. The said money could not be termed to have borne earmark to attribute the same to be the booty of the crime. On investigation, the charge-sheet has been filed. In the circumstances, the Court is inclined to grant the applicant, bail. Hence, following order:

O R D E R

(i) The Bail Application is allowed.

(ii)The applicant be released on bail in connection with Crime No.0172/2022, registered at Akkalkuwa Police Station, District Nandurbar, for the offences punishable under Sections 392, 395 read with 34 of the Indian Penal Code, on his executing P. R. bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand) with surety bond of the like amount.
