Heard the learned Counsel for parties. The primary contention of the petitioner is that the Labour Court ought to have framed preliminary issue of jurisdiction. The petition is filed in the year 2022 and substantial time has passed by, and that issue of jurisdiction along with other issues is also formulated by the Labour Court by its order dated 21/06/2022. The petitioner has also filed his written statement in the matter. 2.

Learned Counsel appearing for the respondent No.1/ original applicant submits that the issue as regards territorial jurisdiction is not formulated by the Labour Court. Learned Counsel for the opponent has no objection in the event that such a prayer is made to the concerned Court to include the issue of territorial jurisdiction in the issues already framed and the Court may decide the same in accordance with law. Liberty is granted.

Thus, this Court would not interfere impugned order of the Tribunal framing all the issues together. However, at the request of the learned Counsel for both the parties, the Labour Court is directed to decide the pending Application (WCFA) No.18/2021 within a period of six months from the date of production of this order. 4.

Learned Counsel submit that they would co-operate in disposal of the application (WCFA) No.18/2021.
