The petitioner has filed the present petition seeking benefit of old pension scheme under the provisions of the Maharashtra Civil Service (Pension) Rules 1982 on the premise that his appointment order was issued prior to 01.11.2005.

The issue involved in the present petition is no more res integra and is covered by the judgment and order dated 06.09.2022 passed in Writ Petition No.13702/2021 Gangu Murlidhar Zade Vs. The State of Maharashtra 4.

The Writ Petition is accordingly allowed. It is declared that the petitioner would be governed by the provisions of old pension scheme envisaged under the Maharashtra Civil Services (Pension) Rules, 1982, Maharashtra Civil Services (Commutation of Pension) Rules, 1984 and existing General Provident Fund Scheme (GPF).
