Heard learned counsel for the applicant and learned APP for the State.

The applicant is seeking bail in Crime No.220 of 2023 registered with Anandnagar Police Station, District Osmanabad for the offence punishable under Sections 399, 402 of the Indian Penal Code. 3.

In such cases, the raids are conducted and the so-called weapons likely to be used to commit the crime are recovered. The applicant was arrested from the spot of the incident. However, he was taken to the hospital and after his discharge, he was arrested. The similarly situated co-accused have been granted bail. Considering his role attributed in this case, registration of other crimes may not come in his way. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Arjun Babu Kale, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with the above crime, on the conditions that he shall not tamper with the prosecution witnesses.

(iii) The applicant shall attend the concerned police station on each 2nd Wednesday of every month between 05.00 pm to 07.00 pm till conclusion of the trial.
