By this petition, the petitioner is seeking subsistence allowance during the period of his suspension. The relevant facts are set out in the order dated 08.06.2022, passed by this Court. Indisputably, appeal filed by the petitioner, challenging his conviction, is pending before the Hon'ble Supreme Court and the sentence is said to have been suspended.

{2} wp1036221.odt The Division Bench of this Court, to which one of us (Sandipkumar C. More, J.) was a party, has observed that, as the conviction of the applicant still subsists since the appeal is pending before the Hon'ble Supreme Court, the petition need not be entertained.
