Heard learned counsel for the applicants and learned APP for the State.

The applicants are seeking bail in a case registered by the Inspector, State Excise Department, Degloor, District Nanded bearing Crime No.17 of 2023 for the offence punishable under Sections 65(A), (B), (C), (D), (E), (F), 80, 81, 83, 90, 108 of the Maharashtra Prohibition Act and Section 328 of the Indian Penal Code. 3.

In a raid, the Excise Officer find the stock of liquor. The chemical analysis report reveals that the liquor was adulterate. The investigation has been completed. There were no antecedents to the discredit of the applicants. Their detention would serve no purpose. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicants, Ramrao Vitthal Waghmare and Sahebrao Sambhaji Kamble, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) each with one solvent surety in the like amount each in connection with the above crime, on the conditions that they shall not tamper with the prosecution witnesses. (iii) The applicants shall attend the trial on each effective date. (iv) The applicants shall refrain themselves from involving in similar crime in future.
