Heard the learned counsel for the applicant and the learned APP for the respondents-State.

The applicant seeks bail in Crime No.30 of 2024, registered with City Chowk Police Station, District Aurangabad, for the offences punishable under Sections 307, 341, 143, 504, 506 read with Section 34 of the IPC.

The applicant and other side had a dispute about the place of constructing the wall of Idgah. In a sudden quarrel, the applicant picked up stones and pelted towards the complainant and witnesses. In that stone pelting, injured suffered the injuries. The alleged weapons have been recovered from the spot. It seems that the incident took place suddenly

934-BA.1382-24.odt on the spot of the incident. The injured has been discharged and nothing is to be recovered from the applicant. He is behind bar since January 2024. The investigation has been completed. The trial may take its time. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant SHOAIB BABA SHAIKH be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) The applicant should not tamper with the prosecution witnesses.

(b) He should attend the trial on each and every date.

(c) He should not go on the disputed Idgah till the trial is concluded.
