Learned counsel for the applicant submits that though intimation of this civil application is already given to Mr. A.S. Gandhi, learned counsel, appearing for respondent Nos. 1 to 3, none present for the said respondents. The appeal came to be dismissed for failure to file paper book. Learned counsel assures that paper book will be filed within four weeks from today.

In view of above and for the reasons stated in the civil application, civil application is allowed in terms of prayer clause "B" and disposed of accordingly.
