Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The applicant seeks bail in Crime No.304 of 2023, registered with Purna Police Station, District Parbhani, for the offences punishable under Sections 302, 120-B, 201 of the IPC and 3, 4, 25 and 27 of the Arms Act.

It has been alleged against the applicant that he was the member of the conspiracy. He purchased the weapon and kept it with another co-accused. Except this, there are no allegations against him. No weapon has been and is to be recovered from him. However, his mobile phone has been recovered. The
935-BA.1385-24.odt applicant was the Upa-Sarpanch. Hence, out of political rivalry, false complaints were registered against him. As far as this case is concerned, there is no direct evidence against him. He is young boy of 28 years. He is languishing in jail for sufficient time. Charge sheet has been filed. No purpose would be served in keeping him behind bar. Therefore, he may be granted bail on certain conditions. Hence, the following order :
O R D E R
(i) Bail Application is allowed.
(ii) Applicant SOMNATH NARHARTI SOLAV be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :
(a) The applicant should not tamper with the prosecution witnesses.
(b) He should attend the trial on each and every date.
(c) He should not enter village Barbadi and tuluka Purna for three months from the date of his release.
