When this Court has shown disinclination to grant relief to applicant no.1 - Sagar, learned counsel for applicants seeks leave to withdraw application to his extent.

Leave granted. Anticipatory Bail Application No.1220 of 2023 stands dismissed as withdrawn qua applicant no.1. 1/2

As far as applicants - Kalu and Arjun are concerned, they are apprehending arrest in connection with Crime No. 56 of 2023 registered with Bodwad Police Station, Tal. Bodwad, Dist. Jalgaon for the offences under Sections 143, 147, 148, 326, 149, 323, 504, 506 of Indian Penal Code, Section 4, 25 of Arms Act and Section 37 (1)(3) of Maharashtra Police Act.

There are no specific allegations against applicants - Kalu and Arjun of using weapon for causing assault. In absence of any overt act against them, their liberty is protected. Hence, following order:

ORDER

(i) Both the applications are allowed qua applicant - Arjun Hanuman Sarwan and applicant no. 2 - Kalu Ananda Sarwan in terms of interim orders dated 11.07.2023 and 25.07.2023 respectively. [ R. M. JOSHI ] JUDGE GGP 2/2
