Heard learned advocate for the applicant and learned Additional Public Prosecutor for the State. Perused the documents.

By this application, the applicant seeks permission to withdraw an amount of Rs.20 lakhs deposited by the applicant in the Trial Court, pursuant to the order dated 19th December, 2019 passed by this Court in Anticipatory Bail Application No. 560 of 2019.

The applicant filed anticipatory bail application in Crime No.

{2} criapln2731-22 54 of 2019 registered with Beed Rural Police Station. This Court, by order dated 19th December, 2019, granted anticipatory bail to the applicant, on condition to deposit Rs.20 lakhs in the Trial Court, which the applicant has deposited.

After conducting investigation, "A" summary report is filed in crime No. 54 of 2019, which is accepted by learned 5th Judicial Magistrate, First Class, Beed, by order dated 2nd February, 2022. 5.

Learned Additional Public Prosecutor was directed to take instructions as to whether said order of acceptance of "A" summary report is challenged. On instructions, learned Additional Public Prosecutor makes a statement that the said order is not challenged by anybody.

In view of aforesaid, the application deserves to be allowed.

In the result, the application is allowed in terms of prayer clause "B". The applicant is permitted to withdraw the amount of Rs.20 lakhs deposited in the Trial Court, along with accrued interest.
