PER COURT :- Heard the learned Counsel appearing for the applicant and learned Counsel appearing for the respondent. Perused the impugned Judgment and the grounds of objection raised in exception to the impugned Judgment.

In view of the above, the following order is passed:-

ORDER

I) The applicant is permitted to withdraw 40% of the deposited amount alongwith interest accrued thereon on submitting an undertaking to the satisfaction of Registrar (Judicial) of this Court. II) Balance 60% amount be invested in Fixed Deposit Receipt in any Nationalized Bank for the period till disposal of the appeal.

III) Appeal be listed after six weeks.
