The applicant has moved this application for service through paper publication on respondents.

As per the office report, respondents no.1 to 3 were not found at the given address and on enquiry made with the Sarpanch and the Police Patil, they reported that respondents no. 1 to 3 are not the resident of their village. So also the service could not be effected on respondent no.4 at the address given as he was not found residing at the given address. 3.

Considering the submissions advanced in the light of averments made in the application supported by affidavit, I am of the view that the case is made out to allow the applicant to serve the respondents by way of substituted service i.e. paper publication.

Accordingly the application is allowed in terms of prayer clause 'B' and 'C' subject to payment of publication charges to concerned news paper with further condition that the notices be published in a news paper having wide circulation in the local area where the respondents shown to be residing as per known address.
