Oral motion is made for modification of the order dated 06.09.2022 whereby the EVMs were allowed to be removed from the strong room, however, with a rider that if so directed those would be produced in the Court.

The learned advocate Mr. Sharma for the Election Commission and the learned advocate Mrs. Sontakke for the Petitioner are unanimous that use and operation/functioning of EVMs is not in dispute. Consequently, the condition imposed in the order date 06.09.2022 putting the respondent Election Commission under an obligation to produce the EVMs as and when directed, shall stand deleted.
