Heard Mr. Deshpande, learned counsel for applicant and Mr. Chapalgaonkar, learned counsel for respondent.

This is an application for condonation of 244 days delay caused for filing first appeal. According to applicant after decision of the Tribunal the claimants came to know about the incorrect documents supplied by the college authority. Therefore, the claimants pursued the College authority for supplying form No. 16 for the year 2009-2010 of the deceased. After many efforts the applicants recently get the said document in the month of May 2015 and thereafter consulted their local advocate and preferred this appeal.

Learned counsel for the insurance company has 1/2

908 delay.odt opposed the application on the ground that the delay has not been properly explained.

Considering the arguments advanced on behalf of the applicants and the grounds/reasons mentioned in the application, I am satisfied that delay has been properly explained, therefore it needs to be condoned. Accordingly it is condoned.

Civil Application is disposed of.

In the first appeal issue notice to the respondents returnable on 18.01.2018.Mr. Chapalgaonkar, learned counsel waives service of notice for respondent No.2.
