Heard the learned Counsel for the petitioner. 2.

The petitioner is challenging the order dated 04.09.2018 passed by the State Information Commissioner, Nashik in appeal No. 5032/2016/Jalgaon.

The learned Counsel for the petitioner submits that though the State Information Commissioner, Nashik had issued notice to the petitioner, the order was passed without hearing him. 4.

I have gone through the order passed by the State Information Commissioner, Nashik and I find that no hearing was given to the petitioner, hence, there is clear violation of principle of natural justice. Thus on this ground the order is not sustainable. Therefore, I am inclined to quashed and set aside the impugned order and remand the matter to the Commission.

In view thereof the petition is partly allowed. The order dated 04.09.2018 passed by the State Information Commission, Nashik in appeal No. 5032/2016/Jalgaon is quashed and set aside. The matter is remanded to the State Information Commission, Nashik to decide it afresh.

The petitioner to appear before the State Information Commission, Nashik on 22.12.2025.

After appearance of the petitioner before the State Information Commission, Nashik, the Commission to decide the proceeding within a period of six months from today. (SIDDHESHWAR S. THOMBRE, J.) mahajansb/
