IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO.10401 OF 2018 (Dilip s/o Babasaheb Jagtap Vs. Shantabai d/o Krushnaji Jagtap and others) Mr.S.S.Choudhary, Advocate for the petitioner. Mr.P.N.Kutti, AGP for respondent Nos. 2 to 5. ( CORAM : Ravindra V.Ghuge, J.) DATE : 17/10/2018 PER COURT :

1.

Learned Advocate for the petitioner has strenuously criticized 3 orders passed by the Revenue Authorities under the M.L.R.Code, 1966 with regard to the mutation entries.

2.

I am not considering this petition for the reason that the Hon'ble Apex Court has concluded in Gurudassing Nawoosing Panjwani Vs. The State of Maharashtra and others [(2016) 2 SCC 213 = 2016(6) ALL MR 468] that a second revision u/s 257 of the M.L.R.Code is a statutory remedy.

3.

In view of the above, this petition is disposed of with liberty to the petitioner to avail of the said remedy. If the revision petition is filed within 4 weeks from today, the time spent by the petitioner in khs/OCT.2018/10401-d

this Court from 02/08/2018 till the filing of the revision would be a good ground for condonation of delay.
