Mr. Deshpande, learned counsel for the appellant submits that, the award is passed against the appellant to the extent of Rs. 28736/- together with 9 % interest. He further submits that, during the pendency of the motor accident claim petition, the appellant has already deposited amount of no-fault liability i.e. Rs. 25,000/-, which the claimant has already withdrawn. He further submits that, in the present proceeding the appellant has deposited amount of Rs. 25,000/- i.e. the amount much more than the award passed by the learned Tribunal.

In view of the statement, the execution and operation of the impugned judgment and award is stayed. 3.

Civil application is disposed of.
