The grievance of the petitioner is that action has been taken by the respondent under Section 207 (1) of the Motor Vehicles Act, 1988 and Section 12 (B) of the Bombay Vehicles Tax Act, 1958, thereby has seized the J.C.B. machine. According to the petitioner, petitioner has filed application in consonance with Section 207 (2) of the Motor Vehicles Act, 1988, however, no decision has been taken upon the same.

In view of the fact that the application of the petitioner is pending, we are not entering into the merits of the matter. The Respondent / Authority shall take decision on the application / representation filed by the petitioner (Exh. A, Page 10) on its own merits, in accordance with law, expeditiously and preferably within three

(3) months.
