Heard the learned counsel appearing for the parties.

The learned counsel appearing for Respondent no.3 has tendered across the Bar the chart showing that out of seven petitioners in case of five petitioners the enquiry has been completed and report report is accepted by the Disciplinary Authority i.e. the District Collector,
9233.15WP Osmanabad and even the penalty is imposed. The said chart is taken on record and marked as `X'
for identification. He submits that, in case of other two petitioners within 2-3 days enquiry report will be received by the Collector and the Collector will take decision within two weeks thereafter.

Since the Petitions take exception to the orders of suspension only and in view of the penalty imposed by the Disciplinary Authority, we cannot proceed further with these Petitions. All the Petitions are disposed of with liberty to the petitioners, in case they are advised, to avail of the appropriate remedy before the appropriate forum taking exception to the penalty imposed by the Disciplinary Authority. Needless to observe that all the grounds raised on merits are left open to be agitated before the appropriate forum, in case the petitioners avail the remedy as available in law.
