PER COURT :- 1.

Learned Advocates for the applicant and respondent No.2 / Mathadi Board, jointly submits that this Court had delivered an order on 18.1.2017 in Writ Petition No. 11560 of 2016 filed by the applicant / Company. The matter was remanded to the Mathadi Board for rehearing.

The applicant / Company was directed to deposit an amount of Rs.24,00,000/- in this Court, which has been deposited. 3.

It is further jointly stated that after a rehearing in the matter, the Mathadi Board, by judgment dated 30.5.2017, has concluded that the Board does not require to carry out any recovery against the applicant / Company as there are no dues outstanding towards them. The learned counsel for the applicant therefore, prays for withdrawal of the amount deposited in this Court. Learned counsel for the Mathadi Board submits on instructions, that considering the judgment of the Board dated 30.5.2017, the Board would not oppose. 5.

Learned AGP submits that the State has no role to play. 6.

Considering the above, this Civil Application is allowed in terms of prayer clause (B), subject to the condition that an authorized officer of the applicant shall make an application duly identified by an Advocate. He shall place on record copy of the authorization letter, identity proof and a copy of the income-tax PAN and Election Commission's Voter Id card.
