None for the applicant in Criminal Application No. 4492 of 2015 filed by the original complainant to assist learned Additional Public Prosecutor. The application stands disposed of. 2.

The applicants are seeking regular bail in Crime No. 70 of 2015 registered at Kalamnuri Police Station, District Hingoli, for the offence punishable under Sections 302, 307, 120-B, 143, 147, 148,

-2149 of the Indian Penal Code for which they were behind the bars since 02/06/2015.

It is an admitted fact that, the charge sheet in the matter is already filed.

Applicant No. 2 is not specifically named in the F.I.R. but for the wife of one Gajanan.

The perusal of the F.I.R. reflects that applicant No.1 was carrying wooden log in her hand, and the nature of injuries i.e. incised wound etc., cannot be caused by wooden log carried by applicant No.1, whereas, no specific role is attributed to applicant No.2.

In view of above referred back ground, particularly in view of the provisions of Section 137 of the Code of Criminal Procedure, it will be appropriate, in my opinion, to order the release of the applicants on bail. Hence, I proceed to pass the following order :- The applicants be released on bail, upon furnishing P.R. Bond of Rs.10,000/- (Rs. Ten thousand) with one surety in the like

-3amount, by each of the applicant, in connection with Crime No. 70 of 2015 registered at Kalamnuri Police Station, District Hingoli, for the offence punishable under Sections 302, 307, 120-B, 143, 147, 148, 149 of the Indian Penal Code.

Criminal Application No.4253 of 2015 is allowed in above terms.
