Applicant seeks to withdraw amount of Rs. 1,05,046/- deposited by the respondent No. 3 - acquiring body. It is pointed out that only marginal enhancement has been granted by the Reference Court considering the policy.

Learned counsel for the respondent - acquiring body opposes the submissions.

Considering the enhancement granted by the Reference

2 08 ca 8218.25 Court and other relevant circumstances, ends of justice would be served in permitting the applicant to receive the amount deposited by the respondents.

The civil application is allowed by permitting the applicant to receive 75% of the amount deposited with accrued interest on furnishing undertaking and remaining 25% of the amount deposited with accrued interest on furnishing solvent surety/security to the satisfaction of the Registrar (Judicial) of this Court.
