IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 73 WRIT PETITION NO.8956 OF 2022 REKHA GANPATRAO ZAMBRE
VERSUS
THE STATE OF MAHARASHTRA THROUGH THE SECRETARY AND OTHERS ...
Advocate for Petitioner: Mr. N. L. Jadhav AGP for Respondent/State: Mr. A. R. Kale ...
CORAM:RAVINDRA V. GHUGE AND ARUN R. PEDNEKER, JJ.
DATE: 06th SEPTEMBER, 2022 PER COURT:
1.
The Petitioner has put-forth prayer clauses 'C' and 'D', as under:- "[C] The Notice dated 25.4.2022 along with the charge sheet dated 25.7.2022 issued by the Chief Executive Officer, Zilla Parishad Osmanabad initiating departmental inquiry may kindly be quashed and set aside.
[D] Pending hearing and final disposal of this writ petition, the execution, operation and implementation of the Notice dated 25.4.2022 along with the charge sheet dated 25.7.2022 issued
2 wp 8956.2022 by the Chief Executive Executive Officer, Zilla Parishad Osmanabad initiating departmental inquiry may kindly be stayed."
2.
After the hearing in this matter progressed to some extent, the learned Advocate for the Petitioner submits that the Petitioner would raise all grounds in defence, in the enquiry. She is due for promotion and if the enquiry is unnecessarily prolonged, it would come in way of her career prospects. It is, therefore, prayed that the enquiry may be concluded within a particular time frame, since Respondent No.3 is already appointed as the Enquiry Officer.
3.
Considering the above, we have not issued notice to the Respondent Zilla Parishad or the Enquiry Officer.
4.
This Petition is disposed off.
5.
We expect the Enquiry Officer to conclude the enquiry in accordance within the time frame as may be prescribed under the Rules and as
3 wp 8956.2022 expeditiously as possible, preferably by 31.12.2022. The Petitioner would render cooperation and the Enquiry Officer would ensure that no stakeholder is unnecessarily granted adjournments or longer dates. All contentions are kept open.
