The applicant is apprehending arrest in Crime No. 216/2021, registered with Shillegaon Police Station, District Aurangabad, for the ofences punishable under Sections 307, 324, 323, 504, 506 read with Section 34 of the Indian Penal Code.

The applicant is a lady aged about 69 years. The case of the prosecution is that the co-accused is the husband and son of the present applicant. The role attributed to the applicant is that she was armed with the wooden stick. The prime role was attributed to the son of the applicant who was arrested. The husband of the applicant is also arrested.

Learned APP submitted that investigation is in progress. Applicant had participated in crime.

Considering the overt act attributed to the applicant, she need not be subjected to custodial interrogation and relief can be granted under Section 438 of the Code of Criminal Procedure.

ORDER

i.

Anticipatory Bail Application No. 1052/2021 is allowed. ii.

In the event of arrest of applicant in Crime No. 216/2021, registered with Shillegaon Police Station, District Aurangabad, she be released on bail on executing P.R. bond in the sum of Rs. 20,000/- (Rupees twenty thousand) with one or more sureties in the like amount.

iii.

The applicant shall appear before the Investigating Ofcer as and when called for till fling of the charge-sheet. iv.

The application is disposed of.
