This is an application for granting of regular bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in connection with Crime No.427 of 2023, registered at Shivaji Nagar Police Station, District Nanded, for the offences punishable under Sections 307, 120(B) and 34 of the Indian Penal Code, 1860, and Sections 4 and 25 of the Arms Act, 1959.

The learned advocate for the applicant pointed out the report in which the informant stated that the applicant and other co-accused were quarreling with Azahar Shaikh. When the informant reached the spot, the applicant allegedly assaulted Azahar Shaikh in the stomach with a knife and co-accused Amol Khandare also attacked the informant with a knife. Thereafter, the informant lodged the report.

The learned advocate for the applicant submitted that the other co-accused has already been released on bail. The applicant has roots in the society and he will not flee away from the trial. Since the charge sheet has already been filed, further custody of the applicant is not necessary. The trial will take long period. It is lastly prayed to grant bail to the applicant. 5.

The learned APP for the State strongly opposed the application and submitted that the applicant has two criminal antecedents. The applicant is involved in a serious crime of attempt to commit murder. Considering his role in the crime and the possibility of his committing similar offences in future, it is lastly prayed to reject the application. 6.

Perused the charge-sheet, particularly the report, injury certificates and the statement of witnesses. The co-accused Avinash @ Lakhan Dhage has already been released on bail. The applicant has roots in the society and he will not flee away from the trial. The trial will take a long period. Considering all these aspects and without adverting to the merits of the case, it would be appropriate to allow the application on the principle that bail is rule and jail is exception, subject to certain conditions. Hence, the following order:

::ORDER::

I.

The application is allowed.

II.

The applicant, in connection with Crime No.427 of 2023,

(( 3 )) 53 BA NO. 1413 OF 2025 registered at Shivaji Nagar Police Station, District Nanded, for the offences punishable under Sections 307, 120(B), and 34 of the Indian Penal Code, 1860 and Sections 4 and 25 of the Arms Act, 1959, be released on bail on furnishing personal bond of Rs.25,000/- with one surety of the like amount on following conditions:- a) The applicant shall not tamper with the prosecution evidence and shall not pressurize the witnesses, in any manner.
