{1}
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD BAIL APPLICATION NO.1419 OF 2020 Mubarak Fattusaheb Sayyed Applicant
Versus
The State of Maharashtra Respondent Mr.A.B.Girase, advocate with Mr.Y.B.Bolkar, advocate for the applicant. Mr.A.S.Shinde, APP for the Respondent.
CORAM : V.K.JADHAV, J.
DATE : 22nd December, 2020.
PC :
The applicant - Mubarak Fattusaheb Sayyed is seeking bail in connection with Crime No.178/2020, registered with Dharangaon Police Station, Tq. Dharangaon, District Jalgaon, for the offences punishable under Sections 4577, 380, 120-B, 413 of the Indian Penal Code.
Heard both sides.
It appears that the investigation is almost over for all practicable purposes and formality of fling charge sheet is only remained. It further appears that main accused Anil Bisram Shinde came to be released on bail by the Additional Sessions Judge, Jalgaon, by order dated 19th December, 2020 in Criminal Bail Application No.9572
{2} of 2020. It has been revealed during the course of investigation that the present applicant is the purchaser of the stolen property. However, prima facie, there is no connecting evidence against the applicant. During the course of investigation, there is no recovery from the applicant so far as stolen property is concerned. Except one crime of the year 2018, there is no serious criminal history. As such, I am inclined to release the applicant on bail.
Hence, the following order:
(i) The application is hereby allowed.
(ii) The applicant - Mubarak Fattusaheb Sayyed, in connection with Crime No.178/2020, registered with Dharangaon Police Station, Tq. Dharangaon, District Jalgaon, for the offences punishable under Sections 4577, 380, 120-B, 413 of the Indian Penal Code, be released on bail on his furnishing Personal Bond of Rs.157,000/- (Rs.Fifteen Thousand) with one surety of the like amount, on the following conditions:
(a) The applicant shall not tamper with the prosecution evidence, in any manner.
(b) The applicant shall attend the concerned Police Station once in a week on every Sunday between 08.00 a.m. to 11.00 a.m., till
{3} fling of the charge sheet.
The application is accordingly disposed of.
