Perused the reply filed by the Respondent/State. The proposal of the petitioner was forwarded to the State Government. The State Government has considered the said proposal and found that the petitioner has to undergo minimum 22 years sentence, since his case falls within the category 3(b) of the Government Resolution dated 11th April, 2008 issued by the Home Department, Government of Maharashtra.

In that view of the matter, no case is made out. The Criminal Writ Petition stands disposed of.

Since, Mr. G.D. Jain, the learned counsel is appointed as Amicus Curie to prosecute the cause of the petitioner, his fees be paid as per the schedule of fees maintained by the High Court Legal Services Sub-Committee, Aurangabad.
