Heard learned counsel for the petitioner and the learned A.P.P. for respondents/State. 2.

In pursuance of the notice issued to the respondents, Shri Vijay Baburao Sonar, Naib Tahsildar, Office of the Divisional Commissioner, Nashik, has filed the affidavit-in-reply. Upon perusal of the said affidavit-in-reply, it appears that when the petitioner was released on parole in

crwp993.16 the year 2009 he did not surrender to jail authorities in time. He was required to be arrested. He jumped the parole and remained absent unauthorizedly for more than 3 years 8 months and 26 days.

In our opinion, the reasons assigned by the respondents authorities while rejecting the application of the petitioner not to release him on parole, are proper and reasonable. Hence, the Writ Petition stands rejected.

Needless to observe, since Shri S.H.Jagyasi, advocate is appointed in this matter as Amicus Curiae to prosecute the cause of the petitioner through the High Court Legal Services Sub Committee, Aurangabad, his fees shall be paid by the said Committee as per the Schedule of Fees maintained by the said Committee.
