O R D E R

Learned Counsel Mr. Satyajeet Dixit alongwith the appellant and the learned Counsel Mr. Abhijit Choudhari for the respondent no.3/ICICI Lombard General Insurance Company Ltd., are present before Panel today. They tender on record terms of settlement. The same is taken on record and marked as 'Exhibit-X' for identification. 2.

For the reasons stated in application, delay in filing First Appeal Stamp No.22153/2020 stands condoned. Office is directed to register First Appeal.

With the assistance of learned Counsels, we have ascertained the identification of the parties. Najeeb

955-CA-1172-2022 -24.

Parties before the Panel pray to dispose of the first appeal in terms of settlement at Exhibit-X.

As per the terms of settlement, the respondent no.3/ICICI Lombard General Insurance Company Ltd. shall deposit an additional amount of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) in the High Court of Bombay Bench at Aurangabad within a period of six weeks from today. On depositing the amount, the same shall be disbursed to the appellant alongwith accrued interest.

The appellant agrees to receive said amount towards full and final settlement of his claim.

The First Appeal is disposed of in terms of settlement at Exhibit-X and the minutes of the order passed today. 8.

The court fees be refunded as per rules.

9.

Award be drawn up accordingly.
