Mr. Kulkarni, learned Counsel for the petitioner seeks liberty to withdraw the petition, with further liberty to file a Revision Petition before the State Government challenging the order passed by the Divisional Commissioner. The only anxiety of Mr. Kulkarni is that the order passed by the Sub Divisional Officer, Bhusawal directing deletion of names of the petitioners from the records of rights may take effect upon expiry of period of 90 days from the date of passing of the order by the Divisional Commissioner, Nashik in July, 2022. 2.

He, therefore, prays that upon filing of the revision before the State Government as well as an application for interim stay, the State Government may be directed to decide at least the stay application within the stipulated period.

Accordingly, the present petition is permitted to be withdrawn and disposed of, with a direction to the State Government to decide the stay application in the revision petition, if filed, within a period of four weeks, from the date of filing of such stay application.
