Learned counsel for the petitioner submits that the applicant had, in fact, insisted for adding a charge under Section 109 of the BNS Act in the representation. However, the concerned investigating officer has added a charge under Section 118(2) of the BNS Act after considering the representation of the applicant. Now the representation has been decided & the appropriate section, as deemed fit by the investigating officer, has been added. Therefore, we find it appropriate to dispose of the petition, granting liberty to the applicant to file an appropriate application at the appropriate stage for the addition of a charge under Section 109 of the BNS Act. Accordingly, the petition is disposed of.
