The applicants are seeking pre-arrest bail, in connection with C.R. No.94 of 2016, registered with Shirur (K) police station, Dist. Beed, for offences punishable under sections 307, 324, 143, 147, 148, 149, 504, 506 of the Indian Penal Code and under section 25 (4) of the Arms Act.

Mr Hange, learned Counsel appearing on behalf of the applicants, upon instructions, makes a categorical statement that accused Bharat, who has actively participated in commission of the crime in question will surrendered within a period of one week from today. 4.

It is brought to my notice that main accused Ambadas is already arrested.

So far as the role attributed to the applicants in the crime in question is concerned, there are no specific attributions qua use of weapon which may result into causing serious bodily injury, which endangers the life of the victim.

Apart from above, there is counter first information report lodged by Ambadas on 24th June, 2016, resulting into registration of C.R. No.89 of 2016 with police station, Shirur (Kasar), for offences punishable under sections 324, 323, 504, 506 read with section 34 of the Indian Penal Code. 7.

In view thereof, custodial interrogation of the applicants is not required and in my opinion, it will be appropriate to order release of the applicants on pre-arrest bail. I, therefore, pass following order :- In the event of arrest of the applicants, in connection with C.R. No.94 of 2016, registered with Shirur (K) police station, Dist. Beed, for

(3) offences punishable under sections 307, 324, 143, 147, 148, 149, 504, 506 of the Indian Penal Code and under section 25 (4) of the Arms Act, they be released on bail, on each of them furnishing P.R. Bond of Rs.15,000/- with one surety in the like amount.

The applicants shall attend the concerned police station initially on 20th and 21st August, 2016, between 10.00 a.m. and 12 noon and thereafter as and when called by the Investigating Officer. Criminal Application stands allowed in above terms. (N.W. SAMBRE, J.) amj
