The caste claim of the petitioner as Thakur, Scheduled Tribe is invalidated.

Mr. Deshmukh, the learned Counsel submits that the father of the petitioner namely Santosh is issued with the validity certificate of Thakur, Scheduled Tribe. The real uncle of the petitioner VijaY, the real paternal aunt Sunita and the cousin uncle Ganesh are issued with the validity certificateS of Thakur, Scheduled Tribe. Before
2 wp 8166.20 issuing validity to the father of the petitioner vigilance was conducted and all these entries were subject matter of consideration. The learned Counsel submits that pre-constitutional documents of the petitioners ancestors record caste as Thakur. According to the learned Counsel, except one isolated entry in the school record of uncle of the petitioner Vijay recorded caste as Thakur / Maratha, there is no contra entry on record. The pre-constitutional documents also record the caste as Thakur. The learned Counsel submits that area restrictions is removed, as such, the place where the petitioner resides is not relevant. The learned Counsel submits that the affinity test is not the litmus test. Reliance is placed on the judgment of the Apex Court in case of Anand Vs. Committee for Scrutiny and Verification of Tribe Claims and others reported in 2011 AIR (SCW) 5559. 3.
Mr. Patil, learned Additional Government Pleader submits that aunt and uncle of the petitioner are issued with the validity certificate by one V. S. Patil committee. The
3 wp 8166.20 learned Counsel further submits that the father of the petitioner so also other relatives before obtaining the validity suppressed the invalidation of the caste claim of the cousin uncle of the petitioner namely Krushna Thansing. His caste claim was invalidated in the year-1990. Said Krushna Thansing suppressed the fact of earlier invalidation and got the validity certificate in the year-2000. The father of Krushna namely Thansing had also applied for validity certificate. His claim was invalidated. In the year-2018 one of the relative of the petitioner Yash Raju had also applied for validity certificate. The same is invalidated. The said judgment is subject matter of challenge in the writ petition filed before this Court.

The learned A.G.P. further submits that validity obtained by suppressing of earlier invalidation orders is fraud upon the committee. 5.
The learned A.G.P. submits that the petitioners have failed in the affinity test. They
4 wp 8166.20 do not belong to the area where ordinarily the persons of Thakur, Scheduled Tribe resides. All these aspects are considered by the committee in right perspective and invalidated the claim.

In school record of the uncle of the petitioner namely Vijay caste is recorded as Maratha Thakur apart from that consistently in the pre-independence documents of the petitioner's grandfather, cousin grandfather caste is recorded as Thakur.

It appears that the caste claim of one Krushna was invalidated in the year-1990. The same is shown to have been validated in the year-2000. 9.
The father of the petitioner, the real uncle of the petitioner so also the real paternal aunt and cousin uncle of the petitioner are issued with the validity certificate of Thakur, Scheduled Tribe. The show cause notices are issued to them.
10. In light of that, we pass the following order.
11. The impugned judgment and order is quashed and set aside. The committee shall issue validity certificate to the petitioner of Thakur, Scheduled Tribe immediately.
12. The said validity certificate shall be subject to the decision that would be taken by the committee in the cases re-opened of the validity holders relied by the petitioner.
13. Writ Petition is accordingly disposed of. No costs.
