IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.9203 OF 2022 SAVITA CHANDRAKANT HINGE
VERSUS
THE STATE OF MAHARASHTRA THROUGH SCHOOL EDUCATION AND SPORTS DEPARTMENT AND OTHERS ...
Advocate for the Petitioner : Ms.Pratiksha Kale h/f Shri Kulkarni Suvidh S.
AGP for the Respondents/State : Shri P.K. Lakhotiya ...
CORAM : RAVINDRA V. GHUGE & SANJAY A. DESHMUKH, JJ.
DATE :- 10th October, 2022 Per Court :- 1.
Leave to correct the description of respondent No.2. Correction be carried out forthwith.
2.
The petitioner has put forth prayer clauses B and C as under :- "B) This Hon'ble Court may please to pass necessary writ, order or direction in like nature and direct the respondent no.2 and 4 to decide representation dated 11.04.2022, 04.05.2022, 23.06.2022, 28.06.2022 and 11.08.2022 as expeditiously as possible and direct the respondent no.3 and 4 to disburse the pending salary of the petitioner.
C) This Hon'ble Court may please to pass necessary writ, order or direction in like nature
*2* 67wp9203o22 and direct the respondent no.5 to permit the petitioner to engage advocate only to the extent of cross examining the witnesses in the enquiry initiated against the petitioner."
3.
After considering the submissions of the learned advocate for the petitioner, it appears that there is some issue with regard to the quantum of salary being paid to the petitioner. If the College is not looking into the problem, it would be appropriate for the Deputy Director of Education, Aurangabad, to consider the grievance of the petitioner, who is a teacher with respondent No.3. The representations cited in prayer clause B are not addressed to respondent No.2.
4.
In view of the above, this Writ Petition is disposed off with liberty to the petitioner to tender a fresh representation to respondent No.2 within two weeks from today. We direct respondent No.2 to hear all the stakeholders including the Management and after considering the grievance of the petitioner in the backdrop of the response of the Management, pass an appropriate order as is permissible in law, preferably on or before 15.11.2022.
