The petitioner's father was serving as a Forest Labourer. The learned Advocate for the petitioner claims that the father of the petitioner was a permanent employee and the scheme of compassionate appointment in Government service would be applicable. However, the record pertaining to the permanent service of his father is not placed before us.

The learned AGP submits that the petitioner would have to approach the learned Maharashtra Administrative Tribunal in the light of Section 3(q) and Section 15 of the Administrative Tribunals Act, 1985.

The learned Advocate for the petitioner submits that this petition may be transmitted to the learned Tribunal at Aurangabad and be converted into an Original Application. 4.
