PER COURT:- 1.

The learned counsel for the petitioner submits that, validation proceeding is pending. The vigilance is also conducted. The vigilance report is served upon the petitioner. The employer has issued notice directing to produce validity or else action would be taken.

The learned A.G.P. accepts notice for respondent nos.1 to 3.

The petitioner shall appear before the Committee on 21.09.2021 and shall file his reply to the vigilance report on the said date. The Committee shall thereafter, decide the proceeding on or before 30.11.2021. In case, the petitioner

(2) 25-wp-10114-2021 does not cooperate with the proceeding before the Scrutiny Committee, then the Scrutiny Committee is at liberty to proceed ahead and decide the proceeding.

In case, the petitioner is still in service, then respondents/employer shall not take adverse action against the petitioner only on the ground that validation proceeding is pending. 5.

The respondents are entitled to take further course of action depending upon the judgment that would be delivered by the Committee in the validation proceeding.

Writ Petition is disposed of. No costs.
