Heard learned counsel for respective parties. 2.

By way of present petition, the petitioners challenge the order dated 07.08.2021 passed below Exhibit-5 in R.C.S. No.1251 of 2019 by the learned Civil Judge, Junior Division, Osmanabad and order dated 12.07.2022 passed by the learned District Judge, Osmanabad in M.C.A. No.34 of 2021.

Both the counsels have submitted that in the present petition, interim order was passed by this Court and the same is in operation from 21.09.2022.

In view of the above facts, without going into the merits of the matter as the suit is of the year 2019, by maintaining the interim order, present petition is disposed of by directing the learned Trial Court to decide the suit within a period of one year from today.

It is made clear that this Court has not given any findings on the merits of the matter and only on the ground that the interim relief was granted in the year 2022 and the same is continued till this date the present petition is disposed of, therefore, the Trial Court shall not be influenced by interim order while deciding the suit.
