Mr. Thigale, learned advocate for the applicant submits that the second appeal is marginally delayed and accounts for the same for the reasons as are appearing in paragraph No.4 of the civil application.

Mr. Lakhotiya, learned advocate appearing for the respondent though purports to oppose, however, is not in a position to challenge veracity of the contents of paragraph No.4 of the civil application.

In the circumstances, I deem it appropriate to condone the

As such, civil application stands granted in terms of prayer clause "B" and is disposed of.
