Learned Counsel for the parties pointed out that present matter is amicably settlement between the parties. The consent terms are drawn and parties are also present before the Court. Joint purshis is also placed on record. Attention of this Court is invited to the consent terms, more particularly, paragraph nos.3, 4 and 6, which reads as under :
"3.
That, appellant/Insurance Company has got no objection for withdrawal of remaining 50% amount Rs.1,58,018/- by the claimants along with interest accrued if any.
{2} FA 1605 OF 2012 4.
That, appellant/Insurance Company would pay balance amount Rs.1,73,963/- (4,90,000 - 3,16,037 = 1,73,963) by Demand Draft / cheque in the name of claimant no.1 6.
That, claimant nos.3 and 4 (Mumtaz Jarin and Firdos Najmim) have become major and got married and residing at their matrimonial house. They have got no objection if the entire amount of compensation is paid to their old age mother claimant / respondent no.1. No objection letters of claimant nos.2, 3 and 4 are filed separately along with this pursis."

In view of joint compromise purshis and consent terms, First Appeal is disposed of as settled.

Respondent no.1/Claimant no.1 to furnish certified copy of the bank details to enable the appellant Insurance Company to pay the amount directly to respondent no.1 through RTGS. Accordingly, respondent no.1 shall also be entitled to receive amount lying in this Court.

Pending Civil Application and Cross Objection are disposed of accordingly.
