By way of Civil Application Nos.12330 and 12328 of 2012, the Applicant / State prays for condonation of delay of 1305 days caused in filing first appeals.
Upon hearing learned AGP, as also on going through the civil applications, I do not find satisfactory reasons to condone the delay of 1305 days. I have examined the impugned judgment and award cursorily and found that the compensation awarded by the Reference Court, cannot be said to be exorbitant.
938 ca.12330.12.odt The learned counsel for Respondent / original Claimant submits that the State has acquiesced the matter in the appeals arises out of the same award and further also withdrawn the matter from the same award before the Lok Adalat.
For all the above reasons, the civil applications for condonation of delay as well as for stay, are rejected. Refund the Court fees as per Rules.
